Terms & Conditions
1Agreement to these Terms
These Terms and Conditions ("Terms") govern your use of makingthemogul.tv and any related pages, forms, text messages, voting tools, and services (together, the "Site"). The Site is operated by Total Entertainment Radio of Wayne County, Michigan ("Total Entertainment Radio," "TER," "we," "us," or "our"), which operates the Making the Mogul show ("Making the Mogul" or the "Show").
By visiting the Site, submitting a form, voting, making a purchase, or opting in to messages, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2Eligibility: 18 and older only
You must be at least 18 years old to use the Site for any purpose, including browsing interactive features, applying as a contestant, voting, purchasing, entering a giveaway, or signing up for messages. By using the Site, you confirm that you are 18 or older and able to enter a binding agreement.
We do not knowingly collect information from anyone under 18. If we learn that someone under 18 has submitted information or votes, we will delete that information and void those submissions and votes.
3Information you provide
You agree to give accurate, current, and complete information in every form you submit, and to update it if it changes. We may reject, suspend, or remove any submission, vote, entry, or participant if we believe information is false, incomplete, or submitted on someone else's behalf without permission.
4Contestant applications
Submitting a contestant application does not guarantee selection, an interview, an appearance on the Show, or any outcome. Casting decisions are made by TER and the Show's producers at their sole discretion and are final.
By applying, you confirm that:
You are 18 or older and the information in your application is true.
You have the right to share every photo, video, logo, business detail, and other material you submit.
You will disclose any business, legal, or contractual matter that could affect your ability to appear on the Show.
You may be asked to sign separate participant agreements, releases, or waivers before filming. Those documents control where they conflict with these Terms.
5Contestant profiles
If you are accepted as a contestant, we may publish an approved profile including your name, business name, photo, biography, business description and social links. Totals, ranks and tiers are not public by default; if standings will be published, we will state that on the voting page or in the round rules. You may request corrections. Hiding a profile prevents new votes once the change takes effect, but does not automatically delete earlier votes, the application or approval. Removal or disqualification may affect participation under the applicable rules.
6Public voting
Public votes may help determine advancement, awards or other results as specified in the applicable round rules. A recorded vote is an initial tally entry, not a guarantee of inclusion in certified results or of any contestant outcome. Final results are subject to the disclosed verification criteria, eligibility checks, fraud review and announced judging or advancement rules.
6.1Voting windows and daily limit
The current system accepts one vote per normalized email address per calendar day across all contestants and categories combined. The day resets at midnight in America/Detroit, including daylight saving time changes. This is not one vote per contestant or category and is not a rolling 24-hour period. Addresses are trimmed and lowercased for this limit. Using aliases or additional addresses to evade the limit is prohibited. Any different limit must be announced and implemented before affected voting begins.
A vote must identify an eligible approved contestant in an active category during its announced window. The server determines acceptance time and eligibility. The age rule in section 2 applies. Use your own name and an email address you control. A phone number is not required for the current ballot. SMS or marketing consent is not required to vote.
6.2Recorded votes and optional verification
A valid vote counts toward the recorded tally as soon as the system accepts and stores it. Email confirmation is optional for submitting that vote. Confirmation does not add a vote or waive the daily limit. Invitations may be delayed during peak traffic. During initial launch, delays may be up to approximately three hours under expected conditions; this is an operational target, not a delivery guarantee. Check spam or promotions and contact us if delayed delivery affects a verification deadline.
Email verification ordinarily occurs once for future votes from that address. A confirmation link ordinarily expires 72 hours after issue. Later eligible votes may be recorded as verified without another daily invitation. Earlier votes retain their original verification status and timestamps. An authorized administrator may verify an address after appropriate direct or event contact and record the basis, time and administrator identity. Verification is a control on the address, not conclusive proof of identity, age, eligibility or one unique human.
6.3Unverified votes and certified results
TER may exclude votes that remain unverified from an official result only where the applicable round rules, disclosed before affected votes are cast, require verification. Those rules must identify the verification deadline, whether eligibility depends on verification at the time of voting or verification of the address by a later cutoff, and the result or award affected. If no verified-only criterion is announced, an otherwise eligible recorded vote will not be excluded solely because optional confirmation was not completed; other eligibility and anti-fraud rules still apply.
If the announced rule uses verification by a later cutoff, TER may use the current email-verification registry and its audit trail to determine eligibility without rewriting the earlier vote's original unverified status. If the rule requires verification at cast, later verification does not convert earlier votes into verified-at-cast votes. Administrator verification may qualify under the same announced cutoff and evidence standards. Recorded totals, originally verified/unverified totals and final eligible totals may therefore differ.
Before excluding votes under a disclosed verification rule, TER will apply the same criteria consistently and provide a reasonable correction or verification opportunity where practicable. Documented system-caused delivery or confirmation failures will be reviewed. TER may announce an extension or alternative verification method rather than treating a delivery failure alone as misconduct. Send questions or requests for review to [email protected].
6.4Prohibited activity and review
Bots, scripted or automated submissions, purchased votes, fabricated identities, unauthorized use of another person's information and methods intended to evade limits are prohibited. Contestants may request support but may not buy votes, participate in vote-manipulation exchanges or offer compensation or rewards for votes. Ordinary use of a shared network or privacy tool alone is not proof of misconduct.
TER may investigate and exclude duplicate, ineligible, manipulated or otherwise invalid votes based on documented review. TER may restrict or disqualify a contestant who directs, participates in or knowingly benefits from manipulation, consistent with the applicable rules. A confirmation email, displayed tally or preliminary standing does not prevent later review. Public standings may be withheld; if displayed, they remain provisional until certification.
6.5Technical interruptions and messages
If the Site reports that your vote was recorded, do not submit again to increase the tally. If a response is lost or times out, a vote may already be stored; follow the retry instructions. Retries remain subject to the daily limit. A busy or closed response does not create an accepted vote. Pausing voting does not necessarily stop processing of accepted votes or invalidate outstanding confirmation links.
An approval or operational email may already be committed to sending when a contestant is later hidden or changes status. An email does not override current eligibility, category schedules or the live board. TER reviews uncertain delivery and status conflicts. Reapproval notifications may be held for staff review.
6.6Pilots and changes to voting
An invited pilot may use the same production system as public voting. Unless a pilot notice states otherwise before participation, pilot applications, contestant approvals and votes are retained under the ordinary rules; approvals do not lapse merely because the public page changes. A pilot notice may identify specific practice votes or demonstration profiles to be archived or excluded before a round opens. Exclusion follows that notice and an auditable process. Hiding a profile alone does not remove earlier votes.
TER may pause or modify voting to address outages, integrity problems or safety concerns. Material changes to eligibility, deadlines, verification or pilot-result treatment will be announced with an effective time. TER will seek to preserve valid accepted votes and apply changes consistently. Emergency suspension is not a blanket right to silently change earlier votes' treatment. Applicable round rules and separately published official Promotion rules govern the stated competition outcome.
7Accounts and access
If any part of the Site requires a login, you are responsible for keeping your login details confidential and for all activity under your account. Tell us right away at [email protected] if you believe your account has been used without permission.
8Changes to the Site and the Show
We may change, suspend, or discontinue any part of the Site, the Show, any season, or any feature at any time. Air dates, platforms, formats, and schedules are subject to change and are not guaranteed.
9Text message (SMS) program
When you check the SMS consent box on a Site form, you agree to receive recurring text messages from Making the Mogul, operated by TER, at the mobile number you provide. Messages may include application updates, casting and interview notices, voting reminders, round results, show and premiere announcements, event invitations, and promotional offers.
Consent is optional. You do not have to agree to texts to apply, vote, or buy anything.
Frequency varies. Message frequency depends on your activity and the Show's schedule.
Costs. Message and data rates may apply, based on your mobile plan.
Opt out anytime. Reply STOP to any message to stop all texts. You will receive one confirmation text and no further messages unless you opt in again.
Help. Reply HELP for help, or contact [email protected] or (313) 217-1588.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Your number. You confirm you are the account holder or authorized user of the number you provide. Tell us if you change or give up that number.
We do not sell or share your mobile number or SMS opt-in consent with third parties for their own marketing. See the Privacy Policy for details.
10Email communications
We may send operational emails about your application, vote receipt, optional address verification, approval or purchase. A vote or verification click does not by itself subscribe you to promotional email or SMS. Marketing messages require the applicable consent or other lawful basis and include an unsubscribe method. Delivery or confirmation does not guarantee selection, an open voting window or inclusion in certified results. See section 6 for verification and delivery rules.
11Paid entries and purchases
Some features may require payment, such as application or entry fees, event tickets, merchandise, sponsorship packages, advertising placements, or digital products (each a "Purchase").
Prices, fees, and what each Purchase includes are shown at checkout. Prices are in U.S. dollars and may change before you buy.
Payments are processed by third-party payment processors. We do not store full card numbers on the Site. Your payment is also subject to the processor's terms.
You authorize us and our processor to charge the payment method you provide, including any applicable taxes.
A paid application or entry fee covers review of your submission only. It does not guarantee selection, advancement, airtime, or any result.
Paying a fee never increases your votes or your chances in public voting.
We may refuse or cancel any order, including for suspected fraud or pricing errors, and will refund any amount charged for a cancelled order.
12Refunds and cancellations
Application and entry fees are non-refundable once your submission has been reviewed. If you withdraw before review begins, email [email protected] to request a refund.
Event tickets are non-refundable unless the event is cancelled by us. If we cancel, you will receive a refund or credit toward a rescheduled event.
Merchandise may be returned unused within 14 days of delivery for a refund, minus shipping, unless the item is marked final sale or was defective.
Digital products and sponsorship or advertising packages follow the terms stated at purchase or in a separate written agreement.
If you are removed for breaking these Terms, fees already paid are not refunded.
Approved refunds go back to the original payment method, usually within 10 business days. Contact us before filing a chargeback so we can resolve the issue.
13Sponsor prizes and giveaways
From time to time, Making the Mogul may offer prizes, awards, giveaways, or sponsor-provided rewards (each a "Promotion"). Each Promotion may have its own official rules, which control if they conflict with these Terms. Unless the official rules say otherwise:
No purchase is necessary to enter or win. A purchase does not improve your chances of winning.
Promotions are open only to legal U.S. residents who are 18 or older. Void where prohibited.
Employees of TER, the Show's production team, sponsors, judges, and their immediate family and household members are not eligible.
Winners are chosen as described in the official rules, which may include judging, public voting, or random drawing.
Winners may need to sign an affidavit of eligibility, a liability release, and a publicity release, and provide tax information, within the time stated. Failure to respond may result in forfeit and an alternate winner.
Prizes are not transferable and cannot be exchanged for cash, except at our discretion. We or the sponsor may substitute a prize of equal or greater value.
Winners are responsible for all taxes on prizes. Prizes worth $600 or more may be reported to the IRS on Form 1099.
Sponsors are responsible for providing and fulfilling sponsor-provided prizes. Sponsor offers are subject to the sponsor's own terms.
We may cancel, suspend, or modify a Promotion if fraud, technical failure, or anything else affects its fairness.
14Sponsors, partners, and third-party links
The Site may feature sponsors, partners, advertisers, and links to third-party websites, platforms, and streaming services. We do not control and are not responsible for their content, products, services, or privacy practices. Any dealings you have with them are between you and that third party. A sponsorship or link is not an endorsement of every product or claim the third party makes.
15Content you submit
You keep ownership of the photos, videos, logos, text, and other materials you submit ("Your Content"). By submitting Your Content, you grant TER and the Show a non-exclusive, worldwide, royalty-free, sublicensable license to use, copy, edit, display, publish, and distribute it to operate the Site, review applications, run voting, and promote the Show, in any media now known or later developed.
This license continues for content already published, aired, or included in promotional materials before you ask us to remove it. You confirm that Your Content does not infringe anyone's rights and that you have permission from anyone shown or named in it.
16Name, likeness, and media
If you appear on the Show, attend a Show event, or are featured as a contestant, judge, sponsor, or guest, you agree that we may record and use your name, image, voice, likeness, business name, and biographical details in the Show and in related promotion, without further payment, unless a separate signed agreement says otherwise. Events and filming locations may be recorded; attending them means you agree to appear in those recordings.
17Acceptable use
You agree not to:
Break any law or these Terms, or help anyone else do so.
Post or submit content that is false, defamatory, harassing, hateful, obscene, threatening, or that infringes anyone's rights.
Impersonate any person or business, or misrepresent your connection to anyone.
Interfere with voting, forms, or Site security, including through bots, scraping, or automated submissions.
Upload viruses or harmful code, or try to access systems or data you are not authorized to access.
Use the Site to send spam or collect other users' contact details.
Harass contestants, judges, sponsors, crew, or other participants, online or in person.
18Our intellectual property
The Making the Mogul name, logos, Show content, Site design, graphics, text, and other materials (other than Your Content and third-party materials) belong to TER or its licensors and are protected by copyright, trademark, and other laws. You may view and share Site pages for personal, non-commercial purposes. You may not copy, modify, sell, or use our marks or content commercially without our written permission.
If you believe content on the Site infringes your copyright, send a notice to [email protected] identifying the work, the infringing material and its location, your contact details, a good-faith statement, and your signature. We will review and remove infringing material where appropriate.
19Disclaimers
The Site, the Show, voting tools, and all content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or secure.
Business information, commentary, and feedback from judges, contestants, sponsors, or guests on the Site or the Show are for entertainment and general information only. They are not legal, financial, tax, or professional advice. Opinions shared belong to the speaker, not TER. Appearing on or winning the Show does not guarantee business success, funding, or income.
20Limitation of liability
To the fullest extent the law allows, TER, the Show, and their owners, officers, employees, producers, judges, sponsors, partners, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of the Site, the Show, voting, Purchases, or Promotions.
Our total liability for any claim relating to these Terms or the Site will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100. Some states do not allow certain limitations, so some of these may not apply to you.
21Governing law, disputes, and arbitration
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.
Informal resolution first. Before filing any claim, you agree to contact us at [email protected] and try to resolve the dispute informally for at least 30 days.
Binding arbitration. If we cannot resolve it informally, any dispute arising from these Terms, the Site, the Show, voting, Purchases, or Promotions will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Wayne County, Michigan, or by video. Either party may instead bring an individual claim in small claims court if it qualifies.
Class-action waiver. You and TER agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative action.
Exceptions. Either party may seek an injunction in court to protect intellectual property rights. Any claim not subject to arbitration will be brought only in the state or federal courts located in Wayne County, Michigan, and you consent to their jurisdiction.
Opt out. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms, with your name and a clear statement that you opt out.
22Indemnification
You agree to defend, indemnify, and hold harmless TER, the Show, and their owners, officers, employees, producers, judges, sponsors, and partners from any claims, losses, damages, and costs, including reasonable attorneys' fees, arising from Your Content, your use of the Site, your participation in the Show or a Promotion, or your breach of these Terms or of anyone's rights.
23Suspension and termination
We may suspend or end your access to the Site, remove Your Content, void your votes or entries, or disqualify you from the Show or a Promotion at any time if we believe you have broken these Terms or acted in a way that could harm TER, the Show, or other participants. Sections that by their nature should survive (including 15, 16, 18 through 22, and 24) survive termination.
24General terms
Entire agreement. These Terms, the Privacy Policy, any official Promotion rules, and any signed participant agreement form the entire agreement between you and TER about the Site.
Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not transfer your rights under these Terms. We may assign ours, including in connection with a sale, merger, or transfer of the Show.
Force majeure. We are not liable for delays or failures caused by events outside our reasonable control.
25Changes to these Terms
We may update these Terms and post the revised version with its effective date. Material changes will be announced on the Site and may be communicated through an appropriate permitted channel. Voting changes remain subject to section 6, including advance disclosure of verified-only result rules and fair treatment of earlier accepted votes. Continued use after the effective date signifies acceptance to the extent permitted by law.

3How we collect it
Directly from you when you fill out a form, vote, buy something, enter a giveaway, reply to a message, or contact us.
Automatically through cookies, pixels, and analytics tools when you use the Site (see section 5).
From service providers such as payment processors (confirming a transaction) and messaging platforms (delivery status and opt-outs).
From public sources and social media when you link your public profiles in an application or interact with our social accounts.
From other people, such as a contestant who nominates or refers you. If you share someone else's information, you confirm you have their permission.

Review contestant applications, run casting, schedule interviews, and coordinate filming.
Create and display approved contestant profiles; publish aggregate results or standings only when enabled and disclosed for the relevant round.

Process purchases, payments, refunds, and chargebacks.
Run giveaways, verify eligibility, deliver prizes, and meet tax reporting duties.

Protect the security of the Site, enforce our Terms, and comply with legal obligations.
5Cookies, analytics, and advertising
We and our partners use cookies, pixels, tags, and similar technologies to keep the Site working, remember your choices, understand how visitors use it, and show and measure ads for the Show.
| Type | Purpose |
|---|---|
| Essential | Run forms, voting, checkout and security. Optional browser storage remembers ballot name/email when you select that feature. |
| Analytics | Count visits, see which pages and contestants draw interest, and fix problems (for example, Google Analytics). |
| Advertising | Show Making the Mogul ads to Site visitors on other platforms and measure ad results (for example, the Meta Pixel and similar tools from Google, TikTok, and other ad platforms). |
Your choices. You can block or delete cookies in your browser settings, use the Google Analytics opt-out browser add-on, adjust ad preferences in your social media accounts, and opt out of interest-based ads at optout.aboutads.info and youradchoices.com. We honor Global Privacy Control (GPC) signals as a request to opt out of targeted advertising for that browser. Blocking some cookies may affect how the Site works.
If you choose the ballot's remember-me option, your browser may store your name and email locally on that device. Use the forget control or clear site data to remove it. Avoid this option on a shared device. Confirmation links contain a private token; do not post or forward them. The voting page uses the token to request verification from our backend. Tokens are not intended for advertising or analytics events.
6Text messages
We send texts only to people who opt in. We keep records of your consent, including the date, time, and form where you gave it, so we can show we have permission.
We do not sell, rent, or share your mobile number or SMS opt-in consent with any third party or affiliate for their marketing purposes. Mobile information is shared only with the service providers that deliver our messages on our behalf.
Reply STOP to any text to opt out, or HELP for help. Message and data rates may apply.
7Public information: profiles and votes
Approved contestant profiles may include name, business name, photo, biography, business details and social links. Public headshots and approved profile content can be viewed, copied or shared by others. Totals, ranks and tiers are not public by default. If standings are enabled for a round, only the disclosed aggregate information will be displayed and may be provisional.
The public voting board does not identify individual voters or publish their email addresses, phone numbers, confirmation tokens, contact IDs, verification records or internal review notes. Contestants are not given voters' contact details through that board. Authorized staff and service providers may access private records for the purposes described in this Policy. Aggregate reporting may distinguish recorded votes from votes eligible for certified results.
8How we share information
We do not sell your personal information for money. We share it only as described below.
Service providers that operate the Site and the Show, including website and CRM hosting, native application/file capture, Google-hosted voting processing and private storage, email delivery and automation where used, as well as payment, analytics and other services actually enabled. Providers process information on our behalf subject to applicable arrangements; some also process technical information under their own terms. A development AI service is not needed to decide whether a live vote counts. Sharing personal records with a development service for another purpose requires separate assessment and appropriate notice or authorization.
Production team members, producers, and judges who review applications, conduct casting, and produce the Show.
Distribution and broadcast partners that air or stream the Show, for contestant information included in Show content.
Sponsors and prize providers, for winner details needed to deliver a prize, or for other details only with your consent (for example, if you check a box to hear from a sponsor).
Advertising and analytics partners, through the cookies and pixels described in section 5. In some states this may count as "sharing" or "selling" for targeted advertising; see section 11 to opt out.
Legal and safety reasons, when required by law, subpoena, or court order, or to protect the rights, safety, or property of TER, the Show, participants, or others, including investigating fraud.
Business transfers, if TER or the Show is involved in a merger, sale, financing, or transfer of assets. Information would remain subject to this Policy's protections.
With your direction or consent, in any other case.
9How long we keep information
We keep personal information only as long as we need it for the purposes in this Policy, unless the law requires longer.
| Information | Typical retention |
|---|---|
| Applications not selected | Up to 2 years, so we can consider you for future seasons, unless you ask us to delete it sooner |
| Contestant records and releases | For as long as the Show or related content is distributed, plus any legal claim period |
| Votes and vote verification data | Up to 1 year after the season ends, including pilot, exclusion and verification audits; longer only for legal obligations or documented disputes |
| Purchase and tax records | 7 years, to meet tax and accounting rules |
| SMS consent and opt-out records | At least 5 years after your last interaction, to document consent |
| Marketing contacts | Until you unsubscribe or ask us to delete them |
Voting audit records may retain original vote-time status after an email is later verified. Excluded or archived pilot votes may remain privately retained for reconciliation, dispute handling and integrity review during the applicable retention period. Hiding a contestant or removing a public profile does not automatically erase the underlying application, vote or audit record. Deletion requests are reviewed under section 11 and applicable legal exceptions.
Content already aired, published, or distributed in the Show or its promotion may not be fully removable.
10How we protect information
We use reasonable administrative, technical, and physical safeguards, including encrypted (HTTPS) connections, access limited to people who need it, and service providers that maintain their own security programs. Payment card details are handled by our payment processors, not stored on the Site. No method of transmission or storage is fully secure, so we cannot guarantee absolute security. If a breach affects your information, we will notify you as required by law.
11Your choices and rights
You can, at any time:
Stop texts by replying STOP.
Stop marketing emails by clicking unsubscribe.
Limit cookies and targeted ads as described in section 5.
Update your information by contacting us.
Depending on where you live, you may also have the right to:
Know and access the personal information we hold about you.
Correct inaccurate information.
Delete your information, subject to legal and contractual exceptions (for example, signed releases or aired content).
Get a copy of your information in a portable format.
Opt out of targeted advertising, the "sale" or "sharing" of personal information as defined by state law, and profiling.
Appeal our decision if we deny your request.
Not be treated differently for using these rights.
To make a request, email [email protected] with the subject line "Privacy Request." We will verify your identity by matching information you give with what we hold, and respond within 45 days, or the time the law requires. An authorized agent may make a request for you with your signed permission. To appeal a decision, reply to our response with "Appeal" in the subject line.
California residents. California law gives you the rights above. In the past 12 months we collected the categories listed in section 2 from the sources in section 3, for the purposes in section 4, and disclosed them to the recipients in section 8. We do not sell personal information for money. Our use of advertising cookies may count as "sharing" for cross-context behavioral advertising; you can opt out through GPC or by emailing us. We do not use sensitive personal information to infer characteristics about you. Under California's "Shine the Light" law, you may ask once a year whether we shared personal information with third parties for their direct marketing; we do not.
12Adults only
The Site is not directed to, and may not be used by, anyone under 18. We do not knowingly collect personal information from minors. If you believe a minor has given us information, contact [email protected] and we will delete it.
13Where information is stored
We are based in the United States, and information is stored and processed in the United States. If you use the Site from outside the U.S., your information will be transferred to and processed in the U.S., where privacy laws may differ from those in your country.
14Changes to this Policy
We may update this Privacy Policy from time to time. We will post the new version on this page with a new effective date. For material changes, we will give notice on the Site and may also notify you by email or text. Continuing to use the Site after changes take effect means you accept the updated Policy.
